This appeared over at Ausiello at EW. USA Network is finalizing a deal to bring Law & Order: CI back for a ninth season, but there’s a catch. Actually there are a few catches. Here’s what I’m hearing… * Julianne Nicholson is out. The actress, who recently gave birth to her second child, has opted not to return. Saffron Burrows (My Own Worst Enemy) has emerged as the frontrunner to replace her. * Burrows would be partnered with Jeff Goldblum, although his deal is also not 100 percent done. * Where does that leave Vincent D’Onofrio and Kathryn Erbe? The CI vets are in talks to return in some capacity. Not sure I like the sound of this! What is 'some capacity'? Then again, it is Ausiello. Oh I wouldn't worry yet about this "some capacity" business. I'd bet the beach house that this is simply Hargitay and Meloni redux.
D'Onofrio has been making noises about how much NBCU earns with multiple spinoffs of CI on various distribution platforms in just about every interview he's given in the last year. A clear sign he wants a bigger cut. And I can't blame him. CI can be viewed on NBC, USA, Sleuth, Universal HD, Bravo (the previous four all owned by NBCU), MyNetwork (national syndication), and syndication to local Fox and independent affiliates. That's just domestic distribution.
Members here (as old as I am) might remember that David Duchovny sued Fox (NewsCorp) over residuals of "The X-Files" on other Fox-owned platforms because Fox was giving its other companies sweetheart syndication deals. Duchovny alleged those arrangements devalued his percentage of the series. (Duchovny wound up with increased compensation.)
I'm not saying this is what's happening with VDO but I am guessing that this is one likely scenario (minus the court papers) that has held up announcement of Season 9.

If that's the case (and I'd never doubt you in these things), would Mr. D'Onofrio's discussions be with Dick Wolf or with NBCU?

Patcat NBCU, Dick Wolf, and Rene Balcer all own percentages of the CI intellectual property. (Balcer's is the smallest piece by far.) I expect that NBCU is the biggest player in such negotiations. NBCU pays licensing fees to Wolf (whose Wolf Films, in turn, funds the production) but it gets the largest piece of the profit pie. For VDO (and Erbe) to get more -- especially in this economy -- some entity (or entities) would have to accept less. There's the gridlock. I fully expect that CI will return for a ninth season with VDO, Erbe, and Goldblum. It's just a matter (which may already be settled as of this writing) of who gives in, how much, and for what other terms. AL EDITED to include this correction from a professional source: - NBC licenses "Law & Order: Criminal Intent" from NBC Universal. NBC Universal produces it. - Dick Wolf and Rene Balcer share the intellectual property rights (proportions unknown); Vincent D'Onofrio also owns a piece -- the smallest piece. And yes, the show goes on to its ninth season in 2010 with a two-hour season opener. AL 9/20/09

My first time back in a very long time, and what do I bring, terrible news: It's shake-up time for "Law & Order: Criminal Intent." Sources from the "L&O" galaxy say that stars Vincent D'Onofrio, Kathryn Erbe, and Eric Bogosian are all expected to be phased out at various points during the series' upcoming ninth season. Julianne Nicholson has already departed because she is having a baby. Executive producer Dick Wolf is turning to Jeff Goldblum, who joined the cast last season, to remain as lead detective in the series along with Saffron Burrows, who was recently cast to replace Nicholson as Goldblum's partner.
